Accessory Dwelling Units
Background:
Since 2018, Accessory Dwelling Units (ADUs) have been allowed within the Town of Hingham under Section V-K of the Zoning By-law. ADUs were allowed upon the granting of a Special Permit from the Zoning Board of Appeals. In 2018, only attached ADUs were allowed, however, in 2023, the By-Law was amended to allow detached ADUs as well.
In 2024, Governor Maura Healey signed Chapter 150 of the Acts of 2024, the "Affordable Homes Act" into law. This new law amended Section 1A and 3A of M.G.L., Chapter 40A, the Zoning Act. This amendment to the Zoning Act, the "Affordable Homes Act", redefined ADUs and allows them to be constructed by-right with a Building Permit in residential zoning districts.
Amendments to the Local Zoning By-Law - Section V-K - Accessory Dwelling Units:
Through the public hearing process, the Planning Board, with the support of the Zoning Board of Appeals, developed amendments to Section V-K of the Hingham Zoning By-Law. The proposed amendments to Section V-K reflect the "Affordable Homes Act", as well as the ADU Regulations (760 CMR 71.00) issued by the Executive Office of Housing and Community Development (EOHLC).
The proposed Amendment to Section V-K of the Hingham Zoning By-Law was approved by the Annual Town Meeting that was held on Monday, April 28th and Tuesday, April 29th.

Permitting Accessory Dwelling Units in the Town of Hingham:
If you wish to permit an ADU in the Town of Hingham, you would do so by applying for a Building Permit through the Building Department's online permitting software (link provided below). The Building Department will require professionally developed plans and other requirements as determined by the Building Commissioner.
Prior to developing plans, it is recommended you meet with someone from either the Building Department or the Land Use & Development Department to confirm your ADU project meets any applicable local and State requirements.
